Terms of Service
By using the PaceMaster website, app, or related services, you agree to these Terms of Service. If you do not agree, please do not use the service.
Marathon racing, long runs, and endurance training carry meaningful risks, including injury, illness, disability, and life-threatening events. Use this product only with that reality in mind.
1. Nature of the Service
- PaceMaster provides informational tools such as pace calculation, race prediction, training guidance, and live-sharing features.
- These tools are for personal reference only. They are not medical advice, training prescriptions, diagnostic opinions, emergency services, or a guarantee of safety.
- You are responsible for deciding whether any result or recommendation is appropriate for your body, experience, and circumstances.
2. High-Risk Sports Disclaimer
- Marathon racing and long-distance training can cause musculoskeletal injury, dehydration, heat illness, hyponatremia, falls, traffic incidents, cardiac events, and other serious outcomes.
- You must independently assess your health, preparation, medical history, weather, course conditions, fueling, equipment, and event rules.
- If you feel unwell, injured, disoriented, overheated, or otherwise unsafe, stop immediately and seek qualified assistance.
- You acknowledge and agree that these are inherent risks of marathon racing, long-distance training, and other endurance activities, and that such risks may exist whether or not you use PaceMaster. You voluntarily choose to participate in these activities and assume all known and unknown risks associated with them.
- To the fullest extent permitted by applicable law, for any injury, illness, death, property loss, interrupted participation, or other damage arising out of or related to your participation in such activities, even if the damage occurs while you are using, relying on, or referring to PaceMaster, PaceMaster Team will not be deemed the creator, organizer, controller, guarantor, or legally responsible party for those inherent risks or resulting harms.
- To the fullest extent permitted by applicable law, you agree not to bring any claim, lawsuit, arbitration, recovery action, or other proceeding against PaceMaster Team arising from or related to the inherent risks of such activities, and you further agree to release and hold harmless PaceMaster Team from related claims, demands, liabilities, losses, costs, or damages, except to the extent liability cannot be disclaimed or limited under applicable law.
3. Reliance on App Outputs
- Pacing outputs, predictions, training zones, and training plans are generated from your inputs and app logic, and may be inaccurate because of input errors, environmental changes, or individual differences.
- You must not treat them as performance guarantees, health assurances, or race-safety determinations.
- PaceMaster Team is not responsible for losses, race mistakes, injuries, or other harm arising from reliance on these results or recommendations.
4. Live Sharing and Availability Disclaimer
- Live sharing depends on device permissions, background behavior, network access, Apple iCloud / CloudKit, map services, and device hardware.
- Location data may be delayed, inaccurate, offset, interrupted, incomplete, or unavailable, and must not be treated as an emergency, rescue, or life-safety system.
- PaceMaster Team is not responsible for failures caused by device issues, permission changes, low battery, network conditions, system restrictions, or third-party platform outages.
5. Subscriptions, Billing, and Refunds
- Premium features may be offered through Apple App Store subscriptions.
- Unless you cancel through your Apple account subscription settings before the end of the current billing period or trial period, the applicable subscription will automatically renew at the end of each billing cycle and continue to be charged at the applicable price and billing interval shown by Apple App Store at renewal.
- If you receive a free trial, discounted trial, or other introductory offer, the subscription will generally convert to a paid auto-renewing subscription at the standard price after the offer period ends unless you cancel in advance.
- The renewal date for an auto-renewable subscription is generally tied to the original purchase date; if calendar differences or Apple platform rules affect that date, the timing shown and processed by Apple App Store will control.
- Pricing, trial offers, auto-renewal, billing cycles, upgrades or downgrades, cancellation, and refunds are governed by the Apple App Store listing, your Apple account subscription settings, and applicable Apple policies.
- You can manage or cancel your subscription on iPhone, iPad, Mac, or through Apple's account management interfaces. If you have questions about billing, renewal, cancellation, or refunds, consult Apple's subscription management tools and support materials first.
6. Service Changes and Interruptions
- We may update, change, suspend, or discontinue parts of the product at any time.
- We do not guarantee uninterrupted availability and are not liable for downtime, delays, or missing data caused by maintenance, upgrades, third-party dependencies, network conditions, or force majeure events.
7. Limitation of Liability
- To the fullest extent allowed by applicable law, PaceMaster Team is not liable for indirect, incidental, special, or consequential damages arising from your use of or inability to use the service.
- This includes, without limitation, training disruption, race disappointment, navigation problems, injury, property loss, data loss, business interruption, or third-party claims.
